EU-domstol - tillåtet att bädda in filmer

EU domstolen har bestämt att inbäddning av filmer på webbsidor inte bryter mot upphovsrätten enligt en artikel, Embedding is not copyright infringement, EU court rules. Det handlar om filmer från främst YouTube som kan bäddas in i en blogg (som jag ofta gör här) eller webbplats. Nuvarande lagstiftning om upphovsrätt täcker inte denna fenomen och EU-domstolens beslut blir nu prejudicerande i Europa. Enligt beslutet är inbäddning bara en förmedling av en kommunikation som sker via den ursprungliga webbplatsen och så länge man inte förändrar innehållet på något sätt kan den inte räknas som en ny kommunikation:

- The embedding in a website of a protected work which is publicly accessible on another website by means of a link using the framing technology … does not by itself constitute communication to the public within the meaning of [the EU Copyright directive] to the extent that the relevant work is neither communicated to a new public nor by using a specific technical means different from that used for the original communication.
